Community to feature manufactured homes

LAUREL -- If everything goes as planned, a 43-acre plot just west of Trap Pond State Park will become the site of a manufactured-home community -- one with a difference.

The economic model behind the proposed New Horizons community could help Delaware cope with its chronic lack of affordable housing if it takes hold here, as it has in other states.

In traditional manufactured-home communities, residents own their homes but rent the land beneath them. This puts them in a difficult position when lot rents rise beyond their ability to pay, and it has led to calls for the General Assembly to enact rent-justification laws and other measures to protect tenants.

But the proposed New Horizons Cooperative community will be operated by the nonprofit Diamond State Community Land Trust. Low- and moderate-income residents would purchase the homes at an affordable price and receive a 99-year, perpetually renewable lease.

Although the trust retains ownership of the land, the lease grants the homeowners and their descendants exclusive use of it. Mortgage payments and property taxes are the responsibility of the owners, who gain the tax benefits of the mortgage interest deduction.

When a homeowner decides to sell, the land trust will appraise the home, calculate a resale price and either purchase it and resell it to an income-qualified buyer or help the owner sell it to a qualified buyer.

A portion of the home's appreciation in value will go back to the land trust, thus allowing the trust to keep the property affordable for the next buyer.

"Based on what it's done in other places in the country, I think it's definitely going to take root," said Van Temple, executive director of the Diamond State Community Land Trust.

Temple predicted that within three to five years the land trust model will provide "a fairly substantial inventory of affordable homes, and in 10 years everyone will know it as a permanent part of affordable housing in Delaware."

That has long been the case in Vermont, where state law requires owners of mobile-home parks who are planning to sell to offer them first to a nonprofit.

The story of moderate-income people being priced out of the market in coastal Sussex County also has a familiar ring to Vermonters.

"One of our big areas that we serve is right at sort of the doorstep to a major ski resort," said Preston Jump, executive director of the Central Vermont Community Land Trust in Barre.

"We've sort of got the same issues [as Delaware], with the competition of the second-home market and people being crowded out of reasonable commuting locales," Jump said.

Jump's land trust operates four mobile-home parks, along with rental apartments and a roster of services designed to promote affordable housing.

But due to a quirk in Vermont law, the requirement that park owners first offer their property to a nonprofit applies only to trailer parks: communities with traditional trailers, not manufactured and modular homes that are put on a permanent foundation.

Jump said he plans to work with state legislators to craft a change in the law, and he hopes the land trust will be able to establish communities similar to what is being planned for Laurel -- though based on a cooperative ownership model instead of a community land trust.

A number of residents of privately owned Delaware manufactured-home communities are exploring the idea of buying out the owners and establishing a co-op.

That leaves New Horizons as what could be the first in an emerging trend for homeownership in Delaware.

According to Temple, the 43-acre site off Wooten Road just west of Trap Pond State Park is under contract, but the purchase has not yet been completed. He would not disclose the selling price, but said, "We're getting a fair deal."

New Horizons, which is expected to open in 2009, will be set up to help those whose finances make it difficult to buy a home.

Two-thirds of the homes will be sold to households with incomes at 50 percent of the area's median income or below, with the rest going to households between 50 percent and 80 percent of the median income.

The area median income in Sussex County is $53,800.

The first 12 families to purchase homes in New Horizons are expected to be former residents of the Dogwood Mobile Home Park near Georgetown who were evicted three years ago when the owner closed the park.

Those residents tried to buy the park and form a co-op to do so, and although that failed the group stuck together, according to Gina Miserendino of the Delaware Housing Coalition.

"We've been working as technical assistance provider and just kind of the wind at their backs," Miserendino said.

Miserendino said she sees the community land trust model as one that could take hold in Delaware, calling it "a good stop on the continuum of housing."

"We think it's a very viable model to pursue. The sheer economics alone: For example, if there are government funds going into it, the subsidy occurs only once," Miserendino said.

The Diamond State Housing Coalition also is working to establish a 36-unit single-family-home community in Milford.

That project, dubbed the Village at Colony South, will be a mix of community land trust homes and homes that will be sold with the land as well.

Jump said Vermont has long tilted toward "the notion of the public's right or the public's interest of preserving a certain portion of land in perpetuity for affordable housing."

Vermont is known for its progressive politics, and what is politically palatable in the Green Mountain State might not go down well in the First State.

However, he said, the need for affordable housing is real, and one way or another it becomes a matter of public policy.

"The bottom line somewhere, some way, is the public picks up the tab."

New form clears up home sale confusion

Effective Nov. 1, all Delaware Realtors have a new sales agreement available for residential property. This agreement has been adapted for all three counties in an attempt to include the best practices from each county.
Prior to Nov. 1, each county used its own agreement of sale. There were significant differences between these documents. This caused some confusion and discrepancies when you were either buying or selling in one county, and buying or selling to another.
Now we have a statewide agreement that will make buying and selling real estate from county to county much easier. Some of the changes include the time frame references. All days are now calendar days as opposed to business days. That would mean if there are seven calendar days for the purchaser to apply for a mortgage, then it would mean seven days in a row.
Other significant changes address the home inspection contingency. There have been many concerns about the home inspection contingency and how to interpret what is a defect and what is not. The new agreement is more specific in defining a "major defect."
Inclusions and exclusions are addressed with a check box and list of items. This list will require careful examination in the preparation, presentation and acceptance of each offer. If a seller wanted to exclude certain appliances, but indicated that said appliances were included, then the seller will be required to leave them.
As an experienced real estate professional, I see the new agreement of sale as a welcome improvement. When I purchased my first home, the sales agreement was only one page on one side. Today, it has grown to multiple pages to address agency, disclosures, personal property, inspections, and many more important items that were not readily known years ago.

Home sales, prices plunge in September

WASHINGTON -- Sales of existing homes plunged by a record amount in September while median home prices dropped by the largest amount in nearly a year, reflecting deepening problems in the housing market.
Analysts said the current downturn is already more severe than the housing slump of the 1990s and they predicted before it is resolved it will rival the 1980-82 housing slump, when the industry was battered by double-digit mortgage rates and a steep economic downturn.
The National Association of Realtors reported Wednesday that sales of existing homes fell 8 percent in September, the largest decline to show up in records dating to 1999. The seasonally adjusted annual sales rate of 5.04 million existing homes was also the slowest pace on record.
The median price -- the point at which half the homes sold for more and half for less -- fell to $211,700 in September, down by 4.2 percent from the sales price a year ago. It was the biggest price drop since last October and marked the 13th time out of the past 14 months that the year-over-year sales price has decreased.
Delaware experienced deeper declines. In New Castle County, 498 homes were sold in September, down 15 percent from the same month last year. Through the first nine months of the year, 5,962 homes were sold in the county, down 9.6 percent from the first nine months of 2006.
Kent County fared even worse. Just 141 homes were sold in September, down 22.1 percent from the 181 homes sold in September 2006. And through the first nine months of the year, there were 1,416 homes sold in Kent County, a 17.5 percent drop from the same period last year, according to Trend multiple listing service.
Meanwhile, the median settled sales price of homes in New Castle County in September was $245,000, up 8.5 percent from the $226,000 figure a year ago. Kent County saw a slight decrease, with a median price of $225,000 this September, compared with $235,000 the same month last year.
Problems in housing worsened in September following a severe credit crunch that hit in August as banks and other lenders tightened standards in the face of soaring mortgage defaults. The market all but dried up for subprime borrowers, those with weak credit histories, and people seeking so-called jumbo loans over $417,000.
Many economists said the problems in housing could well last for another year, given record-high levels of unsold new and existing homes.
"The housing market is unraveling," said Mark Zandi, chief economist at Moody's Economy.com. "We are in a steep downturn and the prospects are that it is going to get worse before it gets better."

Slump in home building intensifies

WASHINGTON -- Construction of new homes plunged to the lowest level in 14 years in September as turmoil in credit markets intensified the problems in the housing industry. Consumer prices, meanwhile, rose at the fastest pace in four months, reflecting higher energy and food costs.
The Commerce Department reported Wednesday that construction of new homes fell 10.2 percent in September to a seasonally adjusted annual rate of 1.191 million units. The decline was more than double the 4.2 percent drop that analysts had been expecting, and it pushed activity down to the lowest level since March 1993.
Meanwhile, the Labor Department reported that consumer prices rose by 0.3 percent in September, slightly more than the 0.2 percent that analysts had been expecting as energy prices rose after three straight declines and food costs shot up at the fastest pace since June. Core inflation, excluding energy and food, remained tame, however, rising by 0.2 percent, in line with expectations.
Analysts said the bigger-than-expected drop in housing construction could be signaling that the housing downturn, already the worst in 16 years, may be headed for bigger troubles. Housing activity is now 30.8 percent below the level of a year ago.
Asked whether the housing slump could push the country into a recession, President Bush said that "I feel good about many of the economic indicators," and said his administration was working to help homeowners deal with rising mortgage delinquencies. "When you got more houses than you got buyers, the price tends to go down. And we're going to have to work through the issue," Bush said.
Private economists were not as certain the steep housing slump will not cause a recession.
"The contraction in housing is transitioning from an average downturn to among the worst in the post-World War II history," said Michael Gregory, an economist with BMO Capital Markets.
After a five-year boom in which housing sales climbed to record highs, demand for both new and existing homes fell last year, and prices, which had been soaring at double-digit rates, have been stagnant.
The slump has intensified in recent months as mortgage lenders have tightened standards for giving loans in response to soaring defaults. The higher defaults and the inability of prospective buyers to qualify for mortgages have contributed to record high levels of unsold new and existing homes.
Federal Reserve Chairman Ben Bernanke and Treasury Secretary Henry Paulson warned this week that the housing downturn was likely to last longer than had been expected.
In its latest look at business conditions around the country, the Federal Reserve said economic growth slowed in the early fall as the troubles in the housing and credit markets weighed on businesses and consumers.
"Contacts in a number of industries indicated a higher-than-usual degree of uncertainty," the Fed said in a report that will form the basis for discussion when policymakers meet Oct. 30-31 to decide whether to cut interest rates further.
Many economists expect housing will trim growth by more than a full percentage point in the current quarter, but they believe the country will avoid an outright downturn because the Fed, which cut rates for the first time in four years in September, will cut rates again should further weakness develop.

First affordable home yet to be built in Sussex County

Details are still being tweaked in the county’s moderately priced housing units program – nine months after the Sussex County Council passed an ordinance to help create more affordable housing for middle-income residents.
The program is in place for county residents with moderate incomes starting at $31,000 to qualify for a one-bedroom townhouse. Although 500 units are proposed as part of the pilot program, not one house has been built. Houses must sell for $160,000 for one bedroom to $222,000 for three or four bedrooms.
The average price for a new house in the county is around $280,000, with the price nearly double that in most areas in the Cape Region. Three developments - including Villages of Elizabethtown in Milton - are included in the first round of the initiative.
Bill Lecates, director of the county’s community development and housing, said he had hoped houses would be occupied by now, but he understands the nature of the building industry.
“It’s a voluntary program,” he said. “It’s very time consuming and does not happen overnight. At least we will have some possible inventory down the road.”
Under the program, developers are given special considerations with greater density and expedited plan reviews for providing affordable housing within new developments. During a workshop Tuesday, Oct. 9, to discuss any possible revisions to the program, most of the talk centered on time limitations.
Under the current ordinance, if a house is not sold within 180 days it can revert back to normal market price. If the property is resold, after 60 days, the county can purchase it or opt to place it back on the market for 90 days. In addition, to be eligible for the program a potential homeowner must be a county resident for one year.The current ordinance passed in January 2006.
Councilman George Cole, who is a Realtor, questioned many of the requirements. He thought the one-year residency requirement was too lenient, and 180 days to sell a house was unrealistic in today’s real estate market.
“It won’t work with these time periods,” Cole said.
Cole said he was afraid developers would take advantage of the system by putting units in the program knowing they would not sell within the 180-day time period. “I’m concerned this is not realistic, and it has the potential to be messed around with,” he said.
He said the time limit should be tied more to the market or the Multiple Listing Service (MLS) average in the county. Councilman Vance Phillips disagreed, reminding his fellow councilman that the program was a pilot program that needs to be left alone to see how it works.
“The market is not an indicator whether these units will sell or not because they are so substantially below market value,” he said.
“It’s not logical to jack up the price if the market is dead,” Phillips added.
Marlena Gibson of the Delaware State Housing Authority said 180 days for a first listing and 90 days on a resell was standard among similar programs. However, the one-year residency requirement was not standard. The residency requirement was much longer than in other programs, she said.
“This is a pilot project and we should stick with it and ride it through. I agree with the expert,” Phillips said.
Phillips noted that $120 million in real estate was transferred in September. “I don’t see where it’s all down and slow out there.”
The council did not make any changes in the time requirements, but several amendments to the ordinance have been proposed. Lecates said most deal with simplifying the regulations within the ordinance and adding more administrative action, while deleting some council action, to speed up the process. In addition, the incentive to have fees waived was removed. The changes will be discussed at the Tuesday, Oct. 16, county council meeting.
“This is a pilot program and we knew that the working group overseeing the program would come up with additional scenarios we may have overlooked,” he said. “We had no template to go by.”
Lecates reminded the council that a new employee needed to be hired in the county’s community development and housing department to replace Albert Phillips who recently retired. The new staff person will have duties involved with the moderately priced housing units program.
“The new person will set the program up and get it running and get the process set up,” County Administrator David Baker said.
Lecates said the market has changed and there is a lot of interest in affordable housing. The second round of developer recruitment for the program will begin in three or four months. “But, if somebody is not on top of the program 24-7, it will be a nightmare,” he said.

WASHINGTON (AP) -- Construction of new homes plunged to the lowest level in 14 years in September as turmoil in credit markets intensified the problems in the housing industry. Consumer prices, meanwhile, rose at the fastest pace in four months, reflecting higher energy and food costs.
The Commerce Department reported Wednesday that construction of new homes fell 10.2 percent in September to a seasonally adjusted annual rate of 1.191 million units. The decline was more than double the 4.2 percent drop that analysts had been expecting and it pushed activity down to the lowest level since March 1993.
Meanwhile, the Labor Department reported that consumer prices rose by 0.3 percent in September, slightly more than the 0.2 percent that analysts had been expecting as energy prices rose after three straight declines and food costs shot up at the fastest pace since June.
Core inflation, excluding energy and food, remained tame, however, rising by 0.2 percent, in line with expectations.
Analysts said the bigger-than-expected drop in housing construction could be signaling that the housing downturn, already the worst in 16 years, may be headed for bigger troubles. Housing activity is now 30.8 percent below the level of a year ago.
Asked whether the housing slump could push the country into a recession, President Bush told a news conference that "I feel good about many of the economic indicators" and said his administration was working to help homeowners deal with rising mortgage delinquencies. "When you got more houses than you got buyers, the price tends to go down. And we're going to have to work through the issue," Bush said.
But private economists were not as certain that the steep housing slump will not cause a recession.
"The contraction in housing is transitioning from an average downturn to among the worst in the post-World War II history," said Michael Gregory, an economist with BMO Capital Markets.
After a five-year boom in which housing sales climbed to record highs, demand for both new and existing homes fell last year and prices, which had been soaring at double-digit rates, have been stagnant.
The slump has intensified in recent months as mortgage lenders have tightened standards for giving loans in response to soaring defaults. The higher defaults and the inability of prospective buyers to qualify for mortgages have contributed to record high levels of unsold new and existing homes.
Both Federal Reserve Chairman Ben Bernanke and Treasury Secretary Henry Paulson warned this week that the housing downturn was likely to persist longer than had been expected.
In its latest look at business conditions around the country, the Federal Reserve said that economic growth slowed in the early fall as the troubles in the housing and credit markets weighed on businesses and consumers.
"Contacts in a number of industries indicated a higher-than-usual degree of uncertainty," the Fed said in a report that will form the basis for discussion when policymakers meet on Oct. 30-31 to decide whether to cut interest rates further.
Many economists expect housing will trim growth by more than a full percentage point in the current quarter, but they believe the country will avoid an outright downturn because the Fed, which cut rates for the first time in four years in September, will cut rates again should further weakness develop.
The National Association of Homebuilders reported this week that its index of builder confidence fell to an all-time low in October.
"Builders are in a panic mode and are trying to catch up with a rapidly falling market," said Mark Zandi, chief economist at Moody's Economy.com.
The government report showed that applications for building permits, considered a good sign for future activity, fell sharply in September, dropping by 7.3 percent to 1.226 million units, also the weakest pace in 14 years.
Only the Northeast showed construction gains in September with activity rising by 45.4 percent in that region. Construction starts fell by 10.1 percent in the West, 11.7 percent in the South and 28.4 percent in the Midwest.
The 0.3 percent increase in consumer prices in September was the largest rise since a 0.7 percent surge last May. Energy costs were up 0.3 percent, while food costs jumped by 0.5 percent.
Analysts expect energy prices to rise even further in the months ahead, reflecting the fact that oil prices have been trading at record highs this week close to $90 per barrel.

WASHINGTON (AP) -- The economy logged slower growth in the early fall as troubles in the housing and credit markets weighed on companies and individuals alike, the Federal Reserve reported Wednesday.
The Fed's fresh snapshot showed that business activity around the country was more subdued but the report didn't suggest that such activity is in danger of collapsing.
"Economic activity continued to expand in all districts in September and early October but the pace of growth decelerated since August," the Fed survey said.
Spending by individuals was uneven and suggests growth was slower in the early fall, the Fed said. "The manufacturing and service sectors continued to expand, but growth weakened - mostly for products and services related to home construction and real-estate transactions," the Fed observed.
To keep the economy expanding, it is vital that companies and people spend and invest at a sufficient pace. The big worry has been that they'll cut back sharply, sending the economy into a tailspin.
The Fed report detected that businesses feel more unsure about the economy's prospects.
"Contacts in a number of industries indicated a higher-than-usual degree of uncertainty about the outlook for economic activity," the Fed survey found.
"Many real-estate contacts expect housing markets to remain subdued for several months," the Fed said. "At firms without direct ties to real estate and construction, contacts are still wary that credit tightening and slowing construction might slow activity in their industry, but there is cautious optimism because few see much evidence of such spillovers at this time."
Federal Reserve Chairman Ben Bernanke, in remarks earlier this week, warned the housing slump will be a "significant drag" on economic growth into next year.
Yet, for all the problems the country has had to cope with, the economic performance so far this year "has been reasonably good," Bernanke said.
The ultimate implications of the credit crunch on the broader economy, however, remain "uncertain," the Fed chief said.
Against that backdrop, economists have mixed opinions about the Fed's next move. Bernanke and his central bank colleagues meet next on Oct. 30-31.
Some analysts think the Fed will leave rates alone, given recent government reports showing that the job market is still sturdy and shoppers are ringing up decent sales at retailers. Others, however, think another rate cut will be ordered to bolster economic growth.
The Fed survey suggested that the nation's employment climate is still in pretty good shape, although "job growth has eased in some regions."
Earlier this month, the Labor Department reported that job creation rebounded in September. Employers boosted payrolls by 110,000, the most in four months. Wages grew solidly. The unemployment rate did creep up to 4.7 percent last month, but that rate is still considered low by historical standards.
The still-good employment situation, coupled with wage gains, has helped to cushion people from the bad effects of the worst housing slump in 16 years and a jarring credit crisis.
Harder to get credit can make it difficult for people to finance big-ticket purchases such as homes and cars, and for businesses to expand operations and hiring.
The Fed survey said "lenders in many districts tightened credit standards, including for consumers and all types of real estate. Consumer lending grew more slowing in most districts. Lending for home mortgages, equity lines and refinancing continued to soften or decline in most districts. Overall business lending was up, but tightening lending standards were applied, particularly for real estate."
The survey was based on information that the Fed's 12 regional banks collected before Oct. 5.
The housing slump deepened, the Fed reported indicated. In some instances, buyers could no longer secure financing or were unable to sell their current homes, the Fed said.
Facing a glut of unsold homes, new-home construction fell 10.2 percent in September to a pace of 1.191 million units. That was the slowest building pace since March 1993, the Commerce Department reported Wednesday.
The commercial real-estate market - for such things as office buildings, stores and other structures - remained solid, the Fed said. However, some reports suggested that "developers are becoming more cautious - in some cases shelving or canceling projects."
On the inflation front, the Fed said high prices were reported for food, energy and raw materials.
Companies, however, have been somewhat limited in passing along all of their increased costs to customers. "Competitive pressures are restraining retail price increases in many instances," the Fed noted.
The Labor Department on Wednesday reported that consumer prices rose 0.3 percent in September, pushed up by more expensive food and energy costs.

NEW YORK -- Wall Street sank for a second straight session Tuesday after Federal Reserve Chairman Ben Bernanke said the slumping housing market remains a "significant drag" on the economy.
Bernanke's speech Monday night in New York elevated concerns that the summer's credit tightness might persist into the winter -- a sobering thought for investors, who are sifting through mixed third-quarter earnings and watching energy costs rise.
"First of all, the worry is we're getting more bad news on housing. No. 2 is higher oil prices. That's a pretty bad combination," said Hugh Johnson, chief investment officer of Johnson Illington Advisors.
Crude oil prices spiked to another record above $88, and a National Association of Home Builders' index that tracks developers' expectations of future home sales fell for the eighth consecutive month to the lowest point since January 1985. Also Tuesday, Treasury Secretary Henry Paulson echoed Bernanke's concerns, saying housing is a significant risk to the economy.
The uncertainty on Wall Street about the economic outlook "comes at a time when earnings results are not particularly exciting -- in fact, are dismal," Johnson said.
The Dow Jones industrial average fell 71.86, or 0.51 percent, to 13,912.94, after falling more than 100 points earlier in the session.
Broader indicators also declined. The Standard & Poor's 500 index slid 10.18, or 0.66 percent, to 1,538.53, and the Nasdaq composite index dipped 16.14, or 0.58 percent, to 2,763.91.
The technology-dominated Nasdaq could get a boost, though, today: Intel Corp. and Yahoo Inc. posted better-than-expected third-quarter results after the bell Tuesday, and their stocks gained sharply in after-market trading.
Crude futures rose $1.48 to a record close of $87.61 a barrel on the New York Mercantile Exchange, after briefly surpassing $88.
