Countrywide Home Loans is facing several lawsuits filed by southeast Texas borrowers affected by Hurricane Rita who claim that the lender violated forbearance agreements and misled them in violation of the Texas Deceptive Trade Practices Act. "Countrywide offered these people a forbearance agreement, telling them they would not owe a lump sum at the end of the deferment and they would pay no fees or penalties--and they just didn't follow through with what they said," says Jason Byrd, a Beaumont attorney representing about 40 homeowners in the region. Countrywide denied the allegations, and declined to comment on the suits or discuss the deferment program offered to displaced homeowners in Jefferson, Orange, Hardin and Jasper counties. The borrowers want Countrywide to forgive their new debt, repay any fees, reimburse court and attorney fees and pay mental anguish damages.
